is it plagirism if you copy a poetic stucture and a similar theme?

i.e. i just realized the song ive been working on has very similar structure to romeo and juliet by dire straits

its called Catherine and Jesse. Catherine was the first real love.

it goes like this.

Catherine was a rich girl from the west side of town
Jesse was a poor boy, he made the rich folks frown
They both had problems and life got them down
Ya well thats life sometimes

To make ends meat, he sold the rich shoes
he had a guitar played the lonely blues
he had nothing and she had it all to lose
but thats love i guess

chorus
Catherine do you remember that first night
I knew right then it was love at first sight
Jesse please just hold me tight
I dont want this moment to end

so far thats what i have, but im wondering if that is plagirism? the tune is completely different. FYI i did romanticise the characters a bit.

i wouldnt think so.  there are so many songs that are similar in both structure and sound now and no one's been sued for that (to my knowledge) yet.

I once wrote a song called Elizabeth and James. It goes like this.

Elizabeth was a poor girl from the east side of town
James was a rich boy, he made the rich folks proud
But both had hard times and life got them down
Yeah ... well thats life sometimes

To make his dough, he sold cars new and used
he had a guitar played the car-dealer blues
he had it all and she had it all to lose
but thats love i guess

If yours is plagiarism then what would Knopfler say about his lyrics? I mean, he used the actual names from Shakespear's great tragedy.  :P I don't think you have to worry about it at all.

it's analog to a lot of songs but it aint plagiarism

a song with many versions.

Ham and Pickle

Pickle was stuck in a jar on the eastern shelf

In a very old book it says there nothing new under the sun.
I copy stuff without know that I have done so.
I guess it depend on the success of the song, I heard cold play got sued and they settled, some good bands have made the mistake of copying the rolling stones music, who copied folks them selves.
If there is money made,
 a lawyer will want there share.

I like songs that have a certain level of familiarity too it :)
